Refund policy
Effective date: 3 September 2026 | Version 1.0 | In-store, click-and-collect and Australia-wide online shipping
IMPORTANT — PLEASE READ BEFORE PURCHASE. Magic: The Gathering singles are collectible goods whose value depends on condition, authenticity, print run, language, foil status and a rapidly changing secondary market. By completing a purchase you acknowledge that you have had a reasonable opportunity to inspect the goods (or to review photographs and the listed condition grade) and that you accept this Policy. Nothing in this Policy excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded.
AT A GLANCE
- Singles, sealed product and graded cards are not returnable for change of mind. Check the card name, set, collector number, language, foil status and condition grade before you pay or complete checkout.
- Your Australian Consumer Law rights always apply. If a card is not as described, misgraded, damaged on arrival or not authentic, you have rights that nothing in this Policy takes away.
- Tell us quickly. Condition, transit damage and wrong-card problems: within 48 hours of collection or delivery. Suspected counterfeit: within 7 days.
- Send photographs first, not the card. Do not post anything back to us until we have accepted the claim in writing and given you a return address and method.
- Do not alter the card while a claim is open. Do not play it, clean it, press it, re-sleeve it into a damaged inner, or submit it for third-party grading.
- We ship tracked only. A carrier "delivered" scan is evidence the article reached the address you gave us, so choose signature on delivery or Express Post on valuable orders.
- This summary is a guide. The full Policy below is what governs your purchase.
1. Who we are and how to use this Policy
Hobby Hub Pty Ltd trading as Games Shed (ABN 64 070 004 643) of 303/28 Bishop St, Woolner NT 0820 (“we”, “us”, “the Store”). Contact for returns: info@gamesshed.com.au / 0488 554 332 / in person at the address above during trading hours.
This Policy applies to all goods we supply in trade or commerce in Australia, whether you buy in store, by click-and-collect, by phone or email, or through our website or social-media shop. It covers Magic: The Gathering singles, sealed product, accessories, consignment stock we sell as principal, and any other hobby goods. It does not apply to private sales between customers, or to goods we buy from you under a separate buy-in / trade-in arrangement.
2. Your rights under the Australian Consumer Law (cannot be excluded)
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
In particular, goods we supply must:
- be of acceptable quality, having regard to the nature of the goods, the price, any statement we make, and (for used or pre-owned cards) age and disclosed condition;
- match the description, photographs and any sample we provided;
- be fit for any particular purpose you made known to us before purchase, and for purposes for which goods of that kind are commonly supplied; and
- come with clear title, free from undisclosed security interests.
Second-hand and pre-owned singles. Most Magic singles we sell are pre-owned collectibles, not factory-new sealed consumer electronics. Acceptable quality is assessed against a reasonable consumer who knows the card’s listed condition grade, price, age and any defects we pointed out before sale. A Lightly Played card is not expected to look Near Mint. A budget common is not expected to be a PSA 10. You cannot later treat ordinary, disclosed wear as a “defect”.
When the guarantees generally will not give you a remedy. Subject always to the ACL, you are not entitled to a refund, replacement or repair merely because you changed your mind, found the card cheaper elsewhere, the market price moved after purchase, you ordered the wrong printing or language, you dislike the artwork or the pull from a sealed product, you later decide the card is not tournament-legal in a format you play, or you damaged, altered, sleeved-poorly, playtested, submitted for third-party grading, or otherwise changed the card after it left our control. If we pointed out a defect before sale, or the defect was obvious on reasonable inspection at the counter and you bought anyway, that defect is not a basis for a later claim.
3. No change-of-mind returns on singles and TCG product
Except where the ACL requires a remedy, we do not accept returns, refunds, exchanges or store credit for change of mind, buyer’s remorse, accidental purchase, duplicate purchase, or “I found it cheaper” on any of the following:
- Magic: The Gathering singles (including foils, special treatments, promos, tokens, and oversized cards);
- graded or slabbed cards (PSA, BGS, CGC, ACE or otherwise);
- sealed TCG product (boosters, boxes, bundles, commander decks, secret lairs, collector boosters, set boosters, and similar);
- mystery, randomised, “pack fresh”, “unsorted”, “bulk”, or live-break product;
- clearance, final-sale, or items marked non-returnable at the point of sale;
- digital codes, Arena codes, or any code once the envelope, email or slip has been opened or the code revealed;
- personalised or made-to-order items; and
- gift cards and store credit once issued.
Reason: singles and sealed TCG product are high-risk for substitution, washing, trimming, re-sealing, and condition disputes. Once a card leaves our sight we cannot reliably prove it is the same card. This restriction is a commercial term. It does not take away ACL rights for goods that fail consumer guarantees.
At our sole discretion we may offer store credit on a non-TCG accessory that is unused, unopened, in original packaging, with proof of purchase, returned within 7 days. That courtesy is not a promise and does not apply to singles.
4. Condition grades, photographs and inspection
We grade singles using a visual, in-house scale consistent with common Australian TCG practice (typically Near Mint / Lightly Played / Moderately Played / Heavily Played / Damaged, or as stated on the ticket or listing). Our grades are opinions formed under shop lighting at the time of listing or sale. They are not third-party professional grades and are not a promise that a grading company will award any particular numeric grade.
You agree that:
- photographs (if any) are illustrative of the specific card or of a representative copy of that printing and condition band — they are not a laboratory scan;
- minor differences that a reasonable collector would treat as within the stated grade (for example a tiny edge nick consistent with Lightly Played, or natural print snow / dots from the factory) are not a failure to match description;
- foil curl, natural holographic pattern variation, centring, print lines, ink dots, and set-typical manufacturing quirks are characteristics of Magic cards, not defects, unless we described the card as free of them;
- language, foil status, set code, collector number and treatment must be checked by you before paying — “I wanted the Special Guest foil, not the regular foil” is change of mind if the listing or ticket was correct;
- in-store and click-and-collect buyers are expected to inspect the physical card under the counter light before leaving. If you decline to inspect, you accept the listed grade as we assessed it at that moment;
- online buyers must read the listed grade, set, foil status, language, collector number and any defect notes, and view every photo on the listing, before checkout. Checkout is your confirmation that you accept the card as listed.
If we have listed a card as Damaged, proxy, altered, signed, artist-proof, or “sold as-is with defects noted”, those disclosed issues cannot later be used as the basis of an acceptable-quality claim.
Our full grading standard, including what each grade means and what we do not treat as damage, is set out in our Card Condition Guide.
5. Claims that a card is not as described, misgraded, damaged on arrival, or not authentic
If you believe a consumer guarantee has not been met, contact us promptly so we can investigate while the facts are fresh. To help us assess the claim we ask that you:
- notify us in writing (email or in person) as soon as practicable, and in any event within 48 hours of collection or delivery for condition, damage-in-transit and “wrong card” issues, or within 7 days for suspected counterfeit or authenticity issues;
- quote the receipt number, date, staff member if known, and the exact card (name, set, foil, collector number);
- provide clear, well-lit, in-focus photographs of the front, back, all four corners and edges, and any area of concern, plus a photograph of the packaging as received if the claim is transit damage;
- keep the card unsleeved-for-photos then re-sleeved, unplayed, unaltered, and not submitted to any grading company until we have finished our assessment; and
- return the card only if and when we ask you to, using a method we specify.
These timeframes are requested so we can investigate fairly. They do not cut down any longer period the ACL may allow in a particular case. Delay, missing photos, or use of the card after you noticed the issue will make it harder for you to prove the problem existed at the time of supply, and we may take that into account.
5.1 How we assess the claim
We will compare the card (or photographs) against our listing, our Card Condition Guide, any photos we took before sale, and CCTV or till records where available. We may obtain a second opinion from another experienced staff member. For authenticity disputes we may use magnification, light tests and comparison copies. We are not a forensic laboratory and we do not warrant that our authenticity opinion will match a later PSA/BGS/CGC determination.
Possible outcomes, depending on the facts and the ACL:
- no remedy, if the card matches the description and is of acceptable quality for its grade and price;
- a partial refund reflecting the difference between the price paid and the fair retail value of the actual condition;
- replacement with the same card in the same or better listed condition if we have stock;
- store credit; or
- a refund of the price paid for that card (original shipping is refunded only if the ACL requires it or the error was ours).
We choose the remedy for a minor failure. You may choose refund or replacement for a major failure, as the ACL provides. We will not refund more than you paid us for that item. Market appreciation after the sale is not added to a refund. Market depreciation is not our problem on a valid change-of-mind refusal, and is not used to reduce an ACL refund of the price paid.
5.2 Cards you must not interfere with
If you play the card, sleeve it in a damaged inner, clean it, press it, re-back it, trim it, colour-in edges, submit it for third-party grading, or otherwise alter it after purchase, you make it substantially harder to show the card is the same item we sold. We may treat that interference as breaking the chain of proof and decline a discretionary remedy. The ACL still applies where you can prove the failure existed at supply.
6. Authenticity
We sell cards we believe to be genuine Wizards of the Coast / Hasbro product (or officially licensed product, as described). We do not sell known counterfeits as genuine. If we sell a proxy, playtest card, or altered art card, it will be identified as such at the point of sale.
If a card we sold as genuine is later shown, on reasonable evidence, to have been counterfeit at the time of supply, that is a failure to match description and a major failure. Your remedy is a refund of the price paid for that card against return of the card. We may retain the card. We are not liable for consequential loss beyond what the ACL requires (for example tournament entry fees, lost prizes, or “what the card is worth on Facebook now”).
A later third-party grading company “altered” or “counterfeit” label is evidence we will consider. It is not automatically conclusive if the card has left our control, been handled, or been in a position where substitution could have occurred.
7. Graded and slabbed cards
A slab is sold as the physical object described: the named card, the named grading company, and the grade printed on the label at the time of sale. We do not guarantee that the grading company would award the same grade if the card were cracked and resubmitted. We do not accept returns because you disagree with the grading company’s assessment, because the slab has ordinary handling marks, or because a different grading company would grade it differently. Cracked slabs, cards removed from slabs after sale, or slabs with broken cases caused after sale, are not returnable except where the ACL requires a remedy for a defect present at supply.
8. Sealed product
Sealed product is sold as sealed. Once the wrap is broken, contents cannot be verified. We do not accept change-of-mind returns on sealed TCG product. Factory seal defects that are obvious and that we pointed out, or typical “set booster vs draft booster” disappointment, are not defects. If a sealed product is empty, contains the wrong product, or arrives with the seal broken due to packing or transit on an order we shipped, contact us under section 5.
9. In-store and click-and-collect
For counter and click-and-collect sales, risk in the goods passes to you when you take physical possession. Check name, set, foil, language and condition before you leave. “I’ll look at it at home” is your choice.
10. Online orders and shipping (Australia Post tracked and express)
This section is the one that matters if we post cards to you. Collectible singles are small, high-value and easy to swap. Empty-mailer claims, “tracking says delivered but I never got it,” and “you sent a different card” are well-known methods of taking advantage of TCG sellers. We pack and ship so we can prove what left the shop. You must give us the evidence we need to investigate. Nothing in this section takes away a genuine ACL remedy where goods were not delivered, arrived damaged because of our packing or the carrier, or were not as described.
10.1 How we pack and despatch
Unless a listing says otherwise, each single is packed in a sleeve and a rigid toploader or equivalent, then in a sealed team bag or tape wrap, then in a tracked Australia Post letter mailer, Express Post envelope, or parcel as selected at checkout. Multiple cards may share a mailer. We may photograph or weigh the packed article before lodgement and we keep the tracking number, lodgement receipt and any packing photos against your order. Those records are the starting point for every shipping claim.
We use tracked services (including Express Post where you pay for it). We do not offer untracked ordinary mail for singles. A tracking number emailed to you is notice that the order has left us.
Despatch timeframes published on the site are estimates, not guarantees. Public holidays, Australia Post delays and events outside our control can add time. Delay on its own is not a basis to cancel a singles order once it has been picked and packed, except where the ACL requires a remedy for a failure to supply within a reasonable time.
10.2 Your address, safe drop and collection points
You are responsible for a complete, correct delivery address, including unit number, and for a phone number and email that work. We are not liable if you typed the address wrong, used a workplace that will not accept mail, or gave a letterbox that cannot take the article.
Australia Post may leave the article in a letterbox, at the door, with a neighbour, in a Parcel Locker, or at a Post Office, in line with their terms and any authority-to-leave or Safe Drop setting on the address. If you do not want unattended delivery, you must choose a service that requires signature or collection (where offered) and pay the extra, or collect in store. An article that tracking records as delivered, safe-dropped, or awaiting collection at a Post Office or Parcel Locker has been delivered for the purpose of this Policy. Theft from a letterbox or doorstep after that scan is generally your risk, not ours, except where the ACL requires otherwise because delivery was not completed in any meaningful sense.
You must collect an article carded to a Post Office or Parcel Locker within Australia Post’s holding period. If it is returned to us as unclaimed, we may charge you the cost of the original postage plus return-to-sender postage before we resend or refund. If you then want a refund rather than a resend, original outbound postage is not refunded unless the ACL requires it.
10.3 When delivery is treated as complete
Subject always to the ACL:
- an Australia Post (or other carrier) scan of “Delivered”, “Delivered to recipient”, “Left in a safe place,” “Delivered to letterbox,” “Awaiting collection,” or an equivalent status is evidence that we have performed delivery to the address you gave;
- we may rely on that scan, any GPS or photo-on-delivery the carrier provides, our packing photos, weight, and lodgement receipt;
- risk in the goods passes to you when delivery is complete in the sense above;
- title passes on full payment.
If tracking still shows the article in the network and it is late, we will lodge an enquiry with Australia Post. We do not refund a tracked article merely because it is slower than the published estimate. If the carrier later confirms loss in transit before delivery, we will replace the card if we still have the same printing and grade, or refund the price of that card (and the shipping you paid for that consignment if the whole consignment was lost). That is the limit of our liability unless the ACL requires more.
10.4 “Tracking says delivered, I never received it”
This is the most common dispute. We will investigate. You must, within 48 hours of the delivered scan (or of the day you say you discovered the problem):
- tell us in writing with the order number and tracking number;
- search the property, letterbox, common mailbox, reception, neighbours and any Parcel Locker or Post Office linked to the address;
- give us any CCTV, doorbell or building-mailroom evidence you have; and
- complete any Australia Post “item enquiry” or statutory declaration we reasonably request.
A delivered scan plus our lodgement record is strong evidence the article reached the address. A bare statement that “it wasn’t there” is not, on its own, proof of non-delivery. We will not automatically refund. We may: wait for the carrier enquiry to finish; offer a replacement only after that enquiry; require a signed statutory declaration under the Statutory Declarations Act 1959 (Cth) or the equivalent State Act; and refuse a second claim of the same kind from the same address or account. If we do refund or replace and the original article later turns up, you must return it or pay for it.
Repeated “delivered but missing” claims from the same customer, household or payment method are treated as a pattern. We may refuse to ship further orders to that address except for click-and-collect, and we may report suspected fraud to the police and to the payment provider.
10.5 Empty mailer, slit mailer, “only a toploader inside,” missing cards
You must photograph the unopened mailer on all sides, the label and tracking barcode, the opened mailer showing how it was sealed, and every insert, before you throw anything away. Keep all packaging until the claim is closed. Claims without those photos will be difficult to prove and we may decline a discretionary remedy.
We pack so a mailer is not empty when it leaves us. If you allege the mailer arrived empty or short-packed:
- we will compare your photos with our packing photos, pick list, weight and CCTV where we have them;
- a clean slit, a resealed flap, a mailer that has been steamed or a toploader that is not the type we use are evidence of interference after the article left us or after delivery, not of our failure;
- if the carrier confirms tampering in the network, we will treat it as loss in transit under 10.3;
- if the evidence is consistent with interference after the delivered scan, the loss is yours;
- we will not refund on an empty-mailer claim that is made after the packaging has been discarded, after the card has been “sold on,” or after an unexplained delay.
10.6 Damaged in transit
Photograph the outer packaging, inner packaging and both sides of every affected card before you sleeve or play anything. Contact us within 48 hours of delivery. Bent corners caused by a mailer being folded in a letterbox can happen in the postal network; we will assess whether the damage is consistent with transit and whether the card still matches the grade you paid for. Minor mailer crush that does not take the card below the listed grade is not a major failure. If we accept the claim we will replace or refund that card. We may claim Extra Cover or carrier compensation ourselves; that claim is ours, not a second payout to you.
10.7 Wrong card, extra card, short shipment
Compare the contents to the invoice and listing as soon as the mailer is opened. Tell us within 48 hours. A pick error by us is our problem and we will make it right (return of the wrong card at our direction, then the correct card or a refund). An extra card remains our property and must be sent back; keeping it is not a gift. Do not assume a missing common from a multi-card order means the rare was never packed — check the packing list and photos with us first.
10.8 What we will not treat as a shipping defect
Subject to the ACL, none of the following is a basis for refund or reshipment:
- you chose the cheaper tracked letter when the order value justified Express or signature, and the article took longer than you hoped;
- Australia Post scanned delivered to the correct address and you were not home;
- a neighbour, housemate, receptionist or building manager accepted or moved the article;
- the market price of the card moved between order and delivery;
- you wanted a different printing than the listing specified;
- ordinary letterbox wear that does not change the listed grade;
- you provided a parcel locker, PO Box or workplace that will not accept the service you paid for.
10.9 High-value cards and optional extra cover
For cards or orders above $300 we strongly recommend Express Post and, where available, signature on delivery or extra cover. If you decline those options at checkout to save postage, you accept the ordinary Australia Post compensation cap on that service (often $100 unless extra cover is bought) as between you and the carrier. That cap does not reduce your ACL rights against us if we fail to supply the goods. It does affect what we can recover from the carrier if we have to replace a lost article, and we may take that into account when deciding whether we can keep offering unattended letter-mailer shipping to your address.
10.10 Postage charges
Postage is the price of the delivery service, not part of the card. On a valid ACL refund for a card we failed to supply or that had a major failure on arrival, we refund the card price and a fair portion of postage if the whole consignment failed. On a partial claim (one card in a ten-card mailer) we do not refund postage. We never refund postage for change of mind. We do not ship a replacement until any card we have asked you to return has been received and checked, except where we decide a prepaid replacement is faster.
11. How to return an item we have asked you to send back
Do not post cards to us unless we have accepted the claim in writing and given a return address and method. Unsolicited return parcels may be refused.
Pack each card in a sleeve and rigid toploader, then a tracked mailer. Photograph the packed article and keep the tracking number. Risk on the return journey sits with you until we scan it in, unless the ACL requires otherwise (for example we asked you to return a major-failure item and nominated the carrier). If a return is lost and you cannot produce tracked proof of posting, we may treat the card as not returned.
Unless the ACL requires otherwise (for example a major failure where return costs should not fall on you), you pay return freight. Original outbound freight is only refunded if we shipped the wrong item or we are legally required to refund it.
Proof of purchase or order number is required. Gift recipients have the same ACL rights as the buyer but we may require the original order.
We will inspect every returned card against the listing and against any photos we took before despatch. If the returned card is a different copy — different print run, different wear pattern, different surface, trimmed, cleaned, rebacked, or a proxy — that is substitution. We will refuse the claim, retain the evidence, and may report it.
Refunds, when payable, go back to the original payment method where practicable, or by store credit if you agree. Card-scheme and bank timing is outside our control. We do not cash-refund a card payment without a paper trail.
12. Chargebacks, payment disputes and suspected fraud
If you have a genuine problem, email us first. Opening a chargeback or PayPal / Stripe / shop-pay dispute without contacting us is treated as a dispute, not as a customer-service request. We will upload packing photos, tracking, lodgement receipts and this Policy to the payment provider and ask them to uphold the sale where the evidence supports us.
Filing a chargeback on the basis that you “did not receive” an article that tracking records as delivered, or that a card is “not as described” when it matches the listing photos and grade, may amount to a false representation to the payment provider. We may refuse further online sales to that customer and pursue recovery of scheme fees.
We may cancel an order before despatch if the payment is flagged, the address looks inconsistent with the card, or we reasonably suspect a stolen card or freight-redirect fraud. A cancelled unpaid or reversed order is not a completed sale.
13. Trade-ins, buy-ins and store credit
When we buy cards from you, that is a separate contract. Once we have paid or issued store credit and you have left, we do not reverse the buy because you later regret the price. Store credit is not redeemable for cash except where the law requires. Lost credit slips may be refused unless we can verify the issue in our system.
14. Pre-orders
You may cancel a pre-order and receive a refund of amounts paid for that pre-order at any time before we allocate or fulfil the specific goods to you, except that TCG product allocated or fulfilled (including singles pulled or reserved against your list) is then treated as a completed sale under this Policy. Allocation dates will be advised at the counter or in writing. Failure to collect a fulfilled pre-order within 30 days of notice may result in cancellation and a restocking deduction that reflects our reasonable costs and any fall in resale value, except where the ACL requires a full refund.
15. Unreasonable conduct and abuse of process
We may refuse to deal with a claim, or may serve only the minimum the ACL requires, where: the card returned is a different copy (substitution); photographs are inconsistent with packing photos, till or CCTV records; packaging was discarded before a shipping claim; you have a pattern of “empty mailer” or “delivered but missing” claims; you threaten staff; or you publish false statements about authenticity, condition or non-delivery to coerce a refund. We may refuse future online despatch to that customer or address (click-and-collect only) and may report suspected fraud. That does not remove ACL rights on a genuine failure.
16. Limitation of liability (to the extent the law allows)
To the maximum extent permitted by the ACL and any other applicable law:
- we do not exclude or limit liability for major failures or other liability that cannot be excluded;
- where goods are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited to replacement, repair, or payment of the cost of replacement or repair, at our option;
- we are not liable for loss of profit, tournament prizes, grading fees you chose to incur, market movement, or any indirect or consequential loss, except to the extent the ACL requires compensation for reasonably foreseeable loss;
- our total liability in respect of any single card is capped at the price you paid us for that card, except where the ACL requires more.
17. Privacy and evidence
We may keep listing photos, packing photos, mailer weights, tracking numbers, lodgement receipts, CCTV stills, till records and correspondence for the purpose of fulfilling orders, assessing claims and preventing fraud. We handle personal information in line with the Privacy Act 1988 (Cth) and our privacy notice at https://gamesshed.com.au/policies/privacy-policy.
18. Disputes
If you are not satisfied with our decision, write to returns@gamesshed.com.au and we will review. You may also contact the fair trading / consumer affairs office in your State or Territory, or the Australian Competition and Consumer Commission (ACCC) for information about your rights. Nothing in this Policy stops you from doing so.
This Policy is governed by the laws of the Northern Territory, Australia. The courts of that State or Territory and the Federal courts sitting there have non-exclusive jurisdiction.
19. Changes
We may update this Policy at any time. The version in force at the time of your purchase applies to that purchase. The current version will be available in store and on our website.
20. Acknowledgement at point of sale
Completing a purchase, paying at the till, clicking to confirm an online checkout (including any tick-box that you have read this Policy), or signing a sale slip constitutes acknowledgement that you have had a reasonable opportunity to read this Policy and to inspect the goods or the listing, and that you buy on these terms, subject always to the Australian Consumer Law.
